Warranty conditions
Warranty
Ikarao is a brand owned by Commaxx International B.V. Commaxx International B.V. sells Ikarao products through its subsidiary Commaxx B.V. Accordingly, the general terms and conditions of Commaxx B.V. apply to all offers and purchases made through this website.
These warranty conditions apply to consumers.
Warranty period
For products purchased directly through our official webshop, we apply a standard warranty period of 24 months from delivery of the product.
The warranty period is not automatically extended by warranty services or replacement deliveries carried out under the warranty.
Keep your proof of purchase safe. When submitting a warranty claim, we will ask you to provide proof of purchase, such as an invoice, sales receipt or official order confirmation, so that we can verify the purchase and purchase date.
Warranty claims are assessed in accordance with the applicable statutory provisions.
Where did you purchase the product?
Purchased through our official webshop
If you purchased the product directly through our official Ikarao webshop, Commaxx B.V. is your seller and we will handle your warranty claim.
If the product does not conform to the sales agreement (non-conformity), for example because it does not function properly under normal use, you may submit your warranty claim directly to our customer service team.
Purchased from another shop or webshop
If you purchased the product from an external shop, webshop or marketplace seller, statutory warranty claims must be handled by the seller from whom you purchased the product.
You should therefore submit your warranty claim directly to that seller. The seller is responsible for assessing and handling your claim and may involve us as the supplier or manufacturer if necessary.
Purchasing from an authorised dealer does not, in itself, entitle you to a general additional manufacturer's warranty from Commaxx B.V.
Purchased through a marketplace where we are the seller
If Commaxx B.V. is identified as the seller on your order or invoice, we are responsible for handling the statutory warranty claim.
In that case, we ask you to submit your warranty claim through the relevant marketplace platform so that it remains linked to your order.
Exclusions from warranty coverage
Damage or defects caused by the following circumstances are, in principle, not covered by free warranty service:
- Damage caused by external influences: such as dropping, impact, pressure, fire, lightning, overvoltage, moisture or liquids, where the product was not designed to withstand such exposure.
- Careless or improper use: including accidental damage, incorrect operation, overloading or use contrary to the product specifications.
- Incorrect use of batteries or power sources: including damage caused by leaking, incorrectly inserted or unsuitable batteries, improper power supplies or non-original parts that caused the defect.
- Incorrect positioning, connection, installation or assembly: including failure to follow applicable safety regulations or the instructions in the user, installation or assembly manual.
- Modifications, alterations or additions to the product: where these have caused the defect or damage.
- Professional or commercial use: where the product was designed exclusively for private use and the defect was caused by such use outside its intended purpose.
- Repairs or modifications by third parties: where these caused the defect or damage.
- Normal wear and consumption: including wear consistent with normal use and the expected service life of the relevant part.
Consumables and accessories
Consumables and accessories, such as batteries, rechargeable batteries, antennas, remote controls, cables, buttons and battery covers, may be subject to normal wear or consumption.
Normal wear and depletion are not covered by warranty. However, if an accessory or component itself has a defect covered by the statutory warranty, this will be assessed separately.
An exclusion applies where the defect or damage was caused by the circumstance concerned and does not fall under the seller's statutory responsibility.
Definitions
For the purposes of these warranty conditions, the following terms mean:
Consumer: a natural person acting for purposes outside their trade, business, craft or profession.
Commaxx International B.V.: the company that owns the Ikarao brand.
Commaxx B.V.: the company based in Kerkrade that sells Ikarao products to consumers through this official webshop and is responsible, as seller, for the applicable statutory warranty.
Additional manufacturer's warranty: a separate commercial guarantee expressly provided for a specific product, in addition to the consumer's statutory rights against the seller.
Scope and extent of warranty coverage
If a product does not meet what the consumer may reasonably expect from it, the warranty claim will be assessed in accordance with the applicable statutory provisions.
As a rule, warranty claims are first handled through free repair or replacement. If these remedies are not possible, are not properly carried out, or other statutory circumstances justify it, termination of the sales agreement and a refund of the purchase price may be available.
Where possible, we take into account the consumer's preference for repair or replacement. Commaxx B.V. assesses which method of handling the claim is possible and appropriate, taking into account the applicable statutory rights. In doing so, we consider, among other things, the nature of the defect, the characteristics of the product, the availability of parts and replacement products, and whether the proposed solution is reasonable.
Not all products are suitable for repair. If repair is not possible or appropriate, we assess whether replacement is possible and what further remedies may apply under the law.
In the event of replacement, the returned defective parts or devices may become the property of Commaxx B.V.
Inspection and possible repair charges
If an inspection shows that the defect was caused by improper use or another circumstance not covered by the warranty, a paid repair may be offered where possible.
We will inform you in advance of any inspection, repair and material charges. Work for which charges apply will only be carried out after you have agreed to them.
Additional manufacturer's warranty
Commaxx B.V. does not provide an additional manufacturer's warranty as standard for all Ikarao products.
A specific additional manufacturer's warranty may apply to certain products. This is expressly stated on the product packaging, product page or accompanying warranty documentation.
If you purchased the product from an external shop or webshop, that seller is your first point of contact for handling the statutory warranty. The seller may involve us as supplier or manufacturer if necessary. If an additional manufacturer's warranty has also been expressly provided for the product, its separate terms and the claim procedure described in them apply.
If an additional manufacturer's warranty applies, the terms specific to that warranty will govern it. These terms specify, among other things:
- Which products and components are covered by the additional warranty.
- How long the additional warranty applies.
- Which defects are covered by the additional warranty.
- Which company provides the additional warranty.
- How the consumer can make a claim under the additional warranty.
An additional manufacturer's warranty is separate from the statutory warranty and does not restrict the consumer's rights against the seller.
Submitting a warranty claim
If you have a defective product purchased directly through our official Ikarao webshop, you can submit your warranty claim to our customer service team.
Please have the following information ready:
